90 Day Trial Period Does Not Offer Employers The Protection Employers Think

While the Act itself can be interpreted in several ways it is the court decision of Stokes Valley Pharmacy that is seriously important.
Basically, the decision insists that an employee subject to a 90 Day Trial Period must not be treated differently to an employee who is not subject to a 90 Day Trial Period.
In essence we advise employers wishing to dismiss an employee who is on a 90 Day Trial Period to carry out the procedures laid down as for an employee who is not on a 90 day Trial Period. But we strongly advise employers to seek advice before doing anything.
